Requirements for Divorce

In order to qualify for a divorce in California, you or your spouse:

  • Must have lived in the state for at least six months
  • Must have lived in the county where you intend to file for at least three months
  • Must be legally married

If you and your spouse do not meet these requirements, you may still be able to obtain a legal separation. After being legally separated, you may still file for divorce once you meet the above requirements.

Dissolving a Domestic Partnership

If you and your partner have a domestic partnership instead of a marriage, you may still split up through a dissolution. Some couples may be bound by both a marriage and a domestic partnership. If this is the case, you will need to legally dissolve both arrangements before either partner can remarry.
